Uncontested Divorce

Uncontested Divorce

What is an Uncontested Divorce Protocol?

If a divorce case is to be filed, the spouses must decide whether it will be uncontested or contested. If lawyers are to be given power of attorney in the divorce case, the person giving the power of attorney must have a photograph, the reason being to show the knowledge and consent of the spouses.

Conditions for Uncontested Divorce

This detail is known as the uncontested divorce protocol. The spouses must agree on every item in the prepared protocol. In an uncontested divorce case, an uncontested divorce protocol must be prepared by our lawyers before going to court. This prepared sample uncontested protocol is submitted to the court. Everything must be written in this protocol. When preparing the protocol, the spouses must definitively agree on issues such as compensation, division of property, custody of children if any, division of jewelry, alimony, and surnames. After reaching an agreement, it is signed by our lawyers.

• Spouses must be married for at least 1 year; this period is calculated from the date of marriage.

• Both parties must be determined about divorce.

• A definitive agreement must be reached on alimony, compensation, custody, and all owned assets.

Generally, spouses tend to prefer uncontested divorce because they are concerned about the divorce case taking too long. Uncontested divorce may be appropriate when spouses have fully received their rights, the property allocated to them has been divided, household goods and jewelry have been given to their owners, custody and alimony for children, and visitation days have been fully and appropriately determined, and the at-fault party has accepted their fault.
