Pensions Cannot Be Seized Except for SGK Debts.
According to Article 93 of Law No. 5510 on Social Security and General Health Insurance, "The income, monthly payments, and allowances of insured persons and their beneficiaries, and debts arising from the application of general health insurance provisions to healthcare providers, cannot be transferred or pledged."
However, Article 88 of the same Law states, "They cannot be seized, except for debts requiring follow-up and collection and alimony debts. Requests for seizure in accordance with this paragraph shall be rejected by the enforcement officer if the debtor does not consent."
In short, pensioners' salaries cannot be seized except for SGK debts. SGK can only seize pension salaries for its own debts and for alimony.
Pensions Cannot Be Seized Without the Pensioner's Consent.
In Budget Law No. 5828, published and enacted in the Official Gazette on February 18, 2009, it is stated that "The pension of the beneficiary cannot be seized without their consent," imposing the condition of the pensioner's permission. Enforcement Offices cannot seize pension salaries without the pensioner's permission. The situation for civil servant pensioners is different, as they are subject to Law No. 5434 on the Pension Fund, and there is no provision in their legislation stating that their pensions cannot be seized, and therefore their salaries can be seized.
